Parent Sues Property Management Company Over Negligence Leading to Child’s Injury
Chynna Fontaine, as the legal parent of a minor identified as K.M., has filed a lawsuit against a Florida-based company following an incident that allegedly resulted in injury. The complaint was lodged on November 7, 2024, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, targeting 1951 Brandywine, LLC.
The case revolves around an incident that occurred on August 4, 2023, at the premises owned by the defendant—Palm Beach Grande Condominium Association located at 1485 Lake Crystal Dr., Palm Beach County. According to the complaint, Chynna Fontaine claims that while walking through a hallway on these premises, she encountered a slippery substance which caused her to slip and fall. At the time of the incident, Fontaine was present as a guest or invitee and argues that she conducted herself with reasonable care for her safety.
Fontaine accuses Brandywine of negligence for failing to maintain safe conditions on their property. She asserts that Brandywine had a duty to ensure their premises were free from hazards and to warn visitors of any potential dangers. “The Defendant knew or should have known that there was a slippery substance in the hallway,” reads part of the complaint. Despite this knowledge, it is alleged that Brandywine neither remedied the hazardous condition nor provided adequate warnings about it.
