Plaintiff (insurance company) sues Defendants (manufacturer and installer) over defective water filtration system
Tower Hill Preferred Insurance Company has filed a lawsuit against Dunedin Plumbing, Inc. and Pentair Residential Filtration, LLC, alleging that their negligence led to significant water damage at a residential property. The complaint was filed on November 1, 2024, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida.
The plaintiff, Tower Hill Preferred Insurance Company, acting as subrogee for Paul Duryea, claims that both defendants were responsible for a defective water filtration system that caused over $155,000 in damages to Duryea’s property located at 1609 Canopy Oaks Blvd., Palm Harbor, Florida. According to the lawsuit, Pentair manufactured the faulty filtration system while Dunedin Plumbing installed it. The insurance company argues that both companies failed in their duty to provide a safe product free from defects.
In the complaint, Tower Hill outlines several counts against Pentair and Dunedin Plumbing. They accuse Pentair of breaching implied warranties of merchantability and fitness for a particular purpose by distributing a defective product that leaked and caused extensive water damage. The insurance company also charges Pentair with strict liability and negligence for failing to ensure the safety of its filtration systems or warn users about potential defects.
