A recent court filing has brought to light a serious allegation of negligence involving a condominium association and its management company. The complaint, filed by Ilisa Weiss-Crowley in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida on October 1, 2024, targets Redington Surf Motel Condominium Association, Inc., and Total Realty Services, Inc.

According to the lawsuit, Ilisa Weiss-Crowley claims that on June 27, 2023, she suffered significant injuries due to a fall caused by uneven and broken pavement at the Redington Surf Motel Condominium premises. The plaintiff was reportedly a business invitee at the time of the incident. The complaint accuses both defendants of failing to maintain safe conditions on their property and not warning about potential hazards. Weiss-Crowley alleges that Redington Surf Motel Condominium Association had a non-delegable duty to ensure safety on their premises but failed to do so by allowing hazardous conditions like uneven walkways to persist.

The lawsuit further implicates Total Realty Services, Inc., as they were responsible for managing the property where the incident occurred. It is alleged that Total Realty Services neglected their responsibilities by failing to properly train employees and supervise maintenance operations effectively. They are accused of not adhering to safety policies which would have prevented such dangerous conditions from existing.
