Plaintiff accuses Gulfstream Park Racing Association of Negligence Leading to Severe Injuries
A recent court filing alleges serious negligence on the part of a prominent Florida business, resulting in significant injuries to a visitor. The complaint was filed by Gary Donahue in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on September 12, 2024, against Gulfstream Park Racing Association, Inc.
According to the details of the case, Gary Donahue claims that he suffered severe injuries due to unsafe conditions at Gulfstream Park Racing Association’s premises located at 8898 Lyons Road, Boynton Beach, Florida. On December 20, 2023, Donahue was on the property as a business invitee when his wheelchair got stuck on an uneven and cracked walkway surface. This incident caused him to fall forward and sustain bodily injuries. The lawsuit contends that Gulfstream Park Racing Association failed in its duty to maintain safe walkways and paths for visitors.
The plaintiff asserts that Gulfstream Park Racing Association was negligent in several ways: failing to maintain or adequately maintain the throughways and walkways; allowing these areas to become uneven, chipped, cracked or loose; not warning visitors about these dangerous conditions; and not correcting these hazards despite having knowledge or should have had knowledge about them. “Gulfstream knew or in the exercise of reasonable care should have known of the existence of the dangerous condition,” states the complaint.
