Woman Sues Property Management Companies Over Negligence Leading to Severe Injuries
A Florida woman has filed a lawsuit against two companies, alleging negligence after she sustained severe injuries from slipping on a wet floor in her apartment. Carol Boettcher lodged the complaint on September 5, 2024, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, naming RPM Living, LLC d/b/a 10X Boca Raton and Davis Premier Services LLC as defendants.
According to the court documents, Boettcher was a lawful guest at the residential property located at 5500 N Military Trail, Unit 546, Boca Raton, Florida. On October 12, 2022, she slipped and fell due to a slippery puddle on the floor within her apartment unit. The plaintiff claims that this hazardous condition resulted in severe and permanent physical injuries. The lawsuit states that both RPM Living and Davis Premier Services were responsible for maintaining safe conditions at the property but failed to do so.
The complaint outlines several allegations against the defendants. It asserts that RPM Living and Davis Premier Services had exclusive control over their employees who managed the common areas and individual units of the property. Boettcher’s legal team argues that both companies had a duty of care to ensure safe conditions for guests and invitees but neglected this responsibility. “Defendants had actual and/or constructive knowledge or should have known that various invitees/guests would traverse the common area of the apartment unit,” reads one part of the complaint.
