Local Business Sued for Negligence After Customer Injury
A Palm Beach County resident has filed a lawsuit against a local business for negligence after suffering injuries on their property. On August 29, 2024, Helene Ginsburg filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida, accusing Boca Wharfside LLC of failing to maintain safe premises.
According to the complaint, Ginsburg was visiting Boca Wharfside’s commercial retail and dining property on June 12, 2024, when she tripped and fell on an uneven walkway. The fall resulted in permanent bodily injury. Ginsburg alleges that Boca Wharfside LLC had a duty to ensure the safety of its premises but failed to do so. The plaintiff claims that the defendant “negligently created and/or allowed a hazardous condition to exist” and did not adequately maintain or inspect the premises to prevent such accidents.
The lawsuit outlines several specific accusations against Boca Wharfside LLC. These include failing to correct dangerous conditions that should have been known to them, not warning visitors about these hazards, and neglecting their responsibility to keep walkways safe for customers. “Defendant breached its duty to Plaintiff by committing one or more of the following acts or omissions,” states the complaint, listing negligent maintenance and lack of proper warnings among other failures.
