Dunedin Resident Accuses Local Apartment Complex of Negligence Leading to Severe Injuries
A resident of Dunedin, Florida, has filed a lawsuit against a local apartment complex, alleging negligence that led to severe injuries. On August 30, 2024, Christina Miholics filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against Whispering Hills Limited Partnership, doing business as Whispering Hills Apartments.
According to the court documents, Miholics claims that on November 23, 2023, she suffered a fall due to a dangerous condition on the premises of Whispering Hills Apartments located at 612 Bass Court in Dunedin. The plaintiff asserts that she was walking around one of the apartment buildings when she tripped over a tree stump cut low to the ground. This incident resulted in severe and permanent injuries for Miholics.
The complaint details several allegations against Whispering Hills. It states that the defendant had a duty to maintain the premises in a reasonably safe condition but failed to do so. Specifically, it accuses Whispering Hills of failing to properly manage and maintain the grounds and not warning residents about potential hazards. “Defendant knew or should have known in the exercise of ordinary care that said warning was necessary to prevent injury,” reads one part of the complaint.
