Local Business Accuses Contractor of Breach of Contract Over Permit Failures
A local business is embroiled in a legal battle over alleged contract breaches and negligence. B&B Bowling, LLC, doing business as Strikes @ Boca, filed a complaint against EMS Rolloff, Inc. in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida on August 23, 2024.
According to the complaint, B&B Bowling had leased commercial property at 21046 Commercial Trail in Boca Raton to operate a bowling center. The company posted a $150,000 security deposit as part of the lease agreement. On September 8, 2020, B&B Bowling entered into an agreement with EMS Rolloff for the removal of bowling infrastructure upon lease termination. However, EMS Rolloff allegedly failed to obtain necessary permits from the City of Boca Raton and performed substandard work that led to unsafe conditions.
The complaint states that on September 28, 2020, the City’s code enforcement department issued a Stop Work Order due to EMS Rolloff’s failure to secure permits and perform work adequately. This resulted in additional expenses for the landlord and ultimately caused B&B Bowling to forfeit its security deposit with accrued interest.
