A resident of Palm Beach County has filed a lawsuit against a local property management company, alleging negligence that led to severe injuries. Michael Mitchell lodged the complaint in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida, on August 21, 2024, targeting Principal Development Group, LLC doing business as Luma at Delray.

The lawsuit centers around an incident that occurred on May 1, 2023. According to the complaint, Mitchell was using the outdoor pool at Luma at Delray when he suffered a minor scrape. This seemingly insignificant injury turned into a serious health issue due to what Mitchell claims was contaminated pool water containing dangerous bacteria, including human feces. The plaintiff asserts that the defendant failed in their duty to maintain a safe environment for residents and guests.

Mitchell’s complaint outlines several specific allegations against Principal Development Group. He accuses them of neglecting essential maintenance tasks such as implementing control measures to ensure the pool was free from harmful bacteria and maintaining appropriate water temperatures and biocide levels. Additionally, he claims they failed to have an operational filter pump and did not detect or eradicate dangerous bacteria in the pool. The complaint also states that the defendant did not warn residents about the contamination or prevent them from using the unsafe pool.
