A Florida homeowner has filed a lawsuit against a local pool construction company, alleging negligence that led to severe injuries. Candace Spano lodged the complaint in the Circuit Court for Pinellas County, Florida, on August 16, 2024, targeting Shoney’s Pools LLC.

According to the complaint, Spano contracted Shoney’s Pools LLC on April 22, 2022, to build an in-ground swimming pool and pool deck at her residence in Tarpon Springs. The agreement included sifting and compacting the dirt adjacent to the pool deck. By April 5, 2023, Shoney’s Pools informed Spano that the work had been completed. However, when Spano inspected the area later that day, she found herself sinking into what appeared to be non-compacted dirt and fell onto an exposed PVC pipe. This incident caused her serious injuries including damage to her neck, back, hip, thigh, and hamstring.

The lawsuit claims that Shoney’s Pools LLC failed in multiple duties: constructing the pool area safely, maintaining it properly, correcting known hazards, and warning Spano of any dangerous conditions. “The Defendant negligently and carelessly failed to sift and compact the replaced dirt adjacent to the pool deck,” reads one part of the complaint. Additionally, it alleges that Shoney’s Pools knew or should have known about these hazards through reasonable care but did nothing to mitigate them.
