A Palm Beach County resident has filed a lawsuit against a local condominium association, alleging negligence after suffering injuries from a slip and fall incident. The complaint was filed by Luis Virgilio Ambert in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida, on August 7, 2024, naming Old Port Cove Towers Condominium Association, Inc. as the defendant.

According to the court documents, Ambert claims that on June 1, 2023, he was lawfully present at Old Port Cove Towers’ property located at 115 Lakeshores Drive in North Palm Beach when he slipped and fell due to a foreign liquid substance believed to be water. The hazardous condition was allegedly caused by water entering the building from a portion of the roof or ceiling. Ambert asserts that this created a dangerous situation that the condominium association failed to address adequately.

The plaintiff’s complaint details several allegations of negligence against Old Port Cove Towers. It states that the association had a duty to maintain its premises in a reasonably safe condition and protect visitors from harm. However, it is alleged that they failed in this duty by not removing or remedying the hazardous condition of the stairwell floor on the penthouse level. Specific accusations include failing to exercise reasonable care in maintaining the stairwell floor, not conducting proper inspections to identify such dangers, and neglecting to warn visitors about the slippery conditions.
