Man Sues Plumbing Company and Property Owner Over Negligence Leading to Severe Injuries
A man has filed a lawsuit claiming negligence after suffering significant injuries from a fall on a poorly maintained property. Donald Owen lodged the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on July 23, 2024, against All City Septic Inc. and Dev Niketan, LLC.
According to the complaint, Owen was an invitee at 266 Lyons Road in Royal Palm Beach, Florida, on January 1, 2024. The property is owned by Dev Niketan, LLC (referred to as “Niketan”), while All City Septic Inc. (“All City”) was contracted to provide plumbing and septic services at the premises. Owen alleges that he tripped over a hazard left by All City in an area meant for public ingress and egress to restroom facilities outside the main home. The plaintiff asserts that this incident resulted in “significant and life-changing injuries.”
Owen’s complaint details that both defendants were aware or should have been aware of the tripping hazard but failed to inspect, remove, warn about, or prevent such dangers. Specifically, Owen claims that All City had a duty to maintain the work area safely and failed to do so by leaving obstacles in walkways without proper lighting or warnings.
