On June 25, 2024, Jacob Wassey filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against Flagler Pointe Apartments GP LLC.

According to the complaint, Jacob Wassey was a tenant at Flagler Pointe Apartments located at 6367 24th Street S, Saint Petersburg. On June 8, 2024, Wassey suffered serious injuries due to what he claims was negligent maintenance by the apartment complex’s management. The plaintiff alleges that water flooding his kitchen and bathroom created hazardous conditions that led to his injuries. “The Defendant negligently and carelessly maintained the premises,” reads the complaint, accusing Flagler Pointe Apartments of failing to keep the property safe for its tenants.

Wassey’s complaint outlines several specific accusations against Flagler Pointe Apartments. The defendant is said to have breached its duty by allowing a foreign substance to remain on the floor of Wassey’s apartment. This dangerous condition was either known or should have been known by the management due to its persistence over time. The complaint further states that Flagler Pointe Apartments failed in multiple respects: not remedying the hazardous state despite having actual or constructive knowledge of it, allowing dangerous conditions to persist, and not warning tenants about these dangers.
