A man is suing two major corporations after allegedly finding a foreign object in his ice cream, leading to severe injuries. Dexter Bostick filed the complaint against HDIP Inc. and Publix Super Markets, Inc. in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida on June 19, 2024.

According to the court documents, Bostick purchased an ice cream from a Publix store located at 2895 N Military Trail, Palm Beach Gardens, Florida on October 10, 2023. The ice cream was manufactured by HDIP Inc., a foreign profit corporation engaged in shipping, selling, distributing, designing, and manufacturing foods. Upon consuming the product, Bostick claims he bit down on and swallowed a hidden foreign object within the ice cream which caused him significant injury.

The complaint alleges that both HDIP Inc. and Publix Super Markets failed in their duty of care to ensure their food products were safe for consumption. “HDIP breached this duty by selling and placing into the stream of commerce an ice cream with a broken foreign object inside,” states the complaint. Similarly, it accuses Publix of failing to inspect its inventory for foreign objects and representing unsafe food as fit for human consumption.
