A Palm Beach County resident has filed a lawsuit against two companies for alleged negligence that resulted in serious injuries. Stephen Levy lodged the complaint in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida, on June 3, 2024, accusing Home Depot U.S.A., Inc. and Rose Paving, LLC of failing to maintain safe conditions at a shopping plaza.

According to the complaint, Levy was injured on July 20, 2023, while he was a business invitee at the shopping plaza located at 3860 Northlake Boulevard in Lake Park. The lawsuit claims that Home Depot owned and maintained the premises where Levy slipped and fell on rain-wet white painted crosswalk stripes. Home Depot had hired Rose Paving to restripe and paint these crosswalks but allegedly failed to ensure that non-skid slip-resistant paint was used. “The Defendant, HOME DEPOT, caused this crosswalk to be slippery by allowing the painting of said crosswalk stripes with either non-nonskid paint or failing to use enough grit in the non-skid paint,” reads part of the complaint.

Levy’s legal team argues that both defendants were aware or should have been aware of the hazardous condition created by the painted crosswalks when wet. Despite this knowledge, they allegedly did not take appropriate measures to warn visitors or mitigate the risk. The plaintiff asserts that Home Depot had a “non-delegable duty” to maintain its property safely and that Rose Paving failed in its responsibility to apply proper materials for safety.
