Erwin Wuzella sues Publix Super Markets over Negligence Leading to Severe Injuries
In a recent court filing, Erwin Wuzella has lodged a negligence complaint against Publix Super Markets, Inc. The complaint was filed by Wuzella in the Circuit Court of the 15th Judicial Circuit in and for Broward County, Florida on May 22, 2024.
According to the complaint, on September 15, 2023, Mr. Wuzella was shopping at the Publix located at 1339 W. Palmetto Park Road in Boca Raton, Florida when he slipped and fell on liquid that had accumulated on the floor of one of the aisles. The plaintiff alleges that the liquid was not readily visible and no caution signs were placed to alert patrons of any potential danger.
The lawsuit claims that Publix was negligent in several ways: failing to maintain its premises in a reasonably safe condition; failing to inspect the property adequately; failing to remove hazardous conditions such as liquid spills; failing to post warning signs indicating wet floors; inadequately supervising employees responsible for inspecting and cleaning floors; and failing to train employees properly on these procedures. “The negligent condition(s) was known to the Defendant or had existed for a sufficient length of time so that the Defendant should have known of it,” states the complaint.
