Dog owner sued after dog bites woman
Adreana Barbara Kasulke has filed a negligence complaint against Felipe Leon Duprey and Marisol Fernandez in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida. The complaint, filed on May 21, 2024, by attorney Jonathan I. Rotstein, alleges that the defendants are responsible for injuries Kasulke sustained from a dog bite incident.
According to the complaint, on July 2, 2023, Kasulke was lawfully on the premises at 1409 14th Lane in Greenacres, Palm Beach County, Florida. She was making a food delivery when she was attacked by a dog owned and controlled by Duprey and Fernandez. The attack resulted in serious and permanent physical injury to her left leg. The plaintiff claims that both defendants were aware of the dog’s presence and failed to take necessary precautions to prevent the attack.
The complaint cites Florida Statute 767.04 which holds dog owners liable for damages if their dog bites someone who is lawfully on their property or in a public place. “The owner of any dog that bites any person while such person is on or in a public place, or lawfully on or in a private place…is liable for damages suffered by persons bitten,” states the statute.
