Noting inconsistencies between Supreme Court emergency administrative orders, the remote notary law, and its own proposed procedural rule, the Rules of Judicial Administration Committee is taking a new look at how judges can verify witness identification during court proceedings.
The committee, at its session during the Bar’s Fall Meeting, deferred final passage of amendments to Rule 2.530, which governs remote testimony and court appearances.
Committee member and Administrative Law Judge John Newton, chair of the RJAC Drafting Subcommittee, said his subcommittee was reviewing the amendments for final passage at the October meeting when Ninth Circuit Judge Alan Apte raised substantive concerns that were beyond the scope of the drafting panel.
